These Terms of Service (the “Terms”) govern your use of the Pupsona mobile application and the Pupsona website (together, the “Service”). Please read them carefully.

1. Acceptance of terms

By downloading, accessing, or using the Service, you agree to these Terms. If you do not agree, please do not use the Service.

2. Eligibility

You must be old enough to form a binding contract in your jurisdiction to use the Service. If you are using the Service on behalf of another person or an organisation, you confirm you are authorised to accept these Terms on their behalf.

3. Your responsibilities

• Provide accurate information where the Service asks for it.
• Keep any credentials associated with your use of the Service secure.
• Use the Service in compliance with applicable laws.
• Only upload photographs you own or otherwise have the right to use.

4. Photos and content you provide

The Service is designed for photographs of dogs. When you upload an image, you confirm that you have the necessary rights to it and that sharing it with the Service does not infringe anyone else’s rights.

You retain ownership of the content you provide. To operate the Service, you grant Pupsona a limited licence to process your content for the purpose of generating and displaying a profile for you, and for any other purpose you explicitly request — for example, exporting or sharing a card you have created.

Please avoid uploading images of people. Profiles are generated for dogs, and the Service is not intended to analyse, describe, or evaluate human beings.

5. Acceptable use

You agree not to:

• Upload unlawful, harmful, hateful, or infringing content.
• Attempt to disrupt, overload, or reverse engineer the Service.
• Use automated systems to access the Service beyond normal personal use.
• Present output from the Service as professional advice of any kind.
• Resell or commercially redistribute the Service without permission.

6. Accounts

If the Service offers accounts, you are responsible for activity that takes place under yours, and for keeping your access credentials confidential. Where the Service can be used without an account, these Terms still apply to your use of it.

7. Purchases and subscriptions

The Service may offer optional paid features, including subscriptions, through the app store from which you obtained the application. Where that is the case:

• Payment is processed by the app store, not by Pupsona directly.
• Subscription terms, renewal, and pricing are presented before purchase and are subject to the app store’s rules.
• Subscriptions renew automatically unless cancelled through your app store account settings before the end of the current period.
• Refunds are handled by the app store in accordance with its policies.

8. Intellectual property

The Service, including its software, design, text, and branding, is owned by Pupsona or its licensors and is protected by applicable intellectual property laws. These Terms do not transfer any ownership rights to you. You may use profiles generated for your own dog for personal, non-commercial purposes, including sharing them.

9. Third-party services

The Service relies on third-party providers — for example hosting, app distribution, payment processing, and the automated systems used to generate profiles. Your use of the Service may involve those providers processing data on our behalf. Third-party services are governed by their own terms, and Pupsona is not responsible for their content or practices.

10. Advertising

If advertising is introduced to the Service, it will be identified as such, and any related data practices will be described in the Privacy Policy before those features are made available.

11. Entertainment purposes and disclaimers

Profiles generated by Pupsona are intended for entertainment. They are playful interpretations produced by automated systems and are not statements of fact about your dog.

Pupsona does not provide veterinary, medical, behavioural, genetic, or scientific diagnoses, assessments, or advice. Nothing produced by the Service should be relied upon for decisions about an animal’s health, training, care, breeding, or wellbeing. If you have concerns about your dog, please consult a qualified veterinary professional.

The Service is provided “as is” and “as available”, without warranties of any kind, to the fullest extent permitted by applicable law. We do not warrant that the Service will be uninterrupted, error-free, or that generated results will meet your expectations.

12. Limitation of liability

To the fullest extent permitted by applicable law, Pupsona will not be liable for indirect, incidental, special, consequential, or exemplary damages, or for loss of data, profits, or goodwill, arising out of or relating to your use of the Service. Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.

13. Termination

You may stop using the Service at any time and remove the application from your device. We may suspend or discontinue the Service, or your access to it, where necessary — for example to comply with law, to address a security issue, or in response to a breach of these Terms. Sections that by their nature should survive termination will do so.

14. Changes to these terms

We may update these Terms from time to time. When we do, we will revise the date at the top of this page. Material changes will be communicated through the Service where practical. Continuing to use the Service after an update means you accept the revised Terms.

15. Governing law
